1. ACCEPTANCE OF TERMS
These Terms of Use govern the access to and use of all services, features, and content made available through or in connection with Lanakila Volleyball Academy (“Organization,” “we,” “us”) websites and online facilities (collectively, the “Site”), including through user accounts or password-protected portions of the Site (“Member Areas”). Use of the Site by visitors to the Site (“you”) is subject to your compliance with the terms and conditions set forth in these Terms of Use, which supplement any additional guidelines or other terms posted by Organization in relation to specific Site-related services or content.
Although you can access and read portions of the Site by visiting the Site, you may be required to register for an account or provide user details to access certain features—such as signing up for a volleyball program, camp, clinic, or making a payment. Please note that we reserve the right to update or modify these Terms of Use without advance notice by posting revised Terms of Use to the Site. You can determine whether the Terms of Use have been modified since your last visit by viewing the “Last updated” legend posted at the top of this document. By checking any applicable agreement box or by using the Site, you agree to be bound by these Terms of Use and agree to the terms of our Privacy Policy. If at any point you no longer agree to the Terms of Use, please discontinue your use of the Site. Organization may deny service to you at any time, including in the event you do not adhere to these Terms of Use.
2. REGISTERING WITH THE SITE AND ACCOUNT SECURITY
Registering with the Site. Anyone is welcome to check out the Site and sign up to receive news, offers, and program information. To register a child or athlete for a program, purchase items, or transact business with the Organization through the Site, you may be required to create a user account or provide accurate contact and payment information.
Account, Username, and Password. If you register to create an account on the Site, you are responsible for maintaining the confidentiality of your credentials (such as your username and password) and for restricting access to your account. You agree not to transfer your account to another party. You agree to (a) provide and maintain accurate, current, and complete information about yourself and any minors you register; (b) immediately notify Organization of any unauthorized use of your account or any other breach of security; and (c) log out or close down access to Member Areas at the end of each session when using a shared computer.
Account Termination or Deactivation. Organization reserves the right to deactivate or terminate your account or access to the Site at any time, for any reason, without prior notice, including if we believe you have violated these Terms of Use. Upon termination, your license to use the Site automatically ceases.
3. LICENSE AND LIMITATIONS
Subject to your full compliance with these Terms of Use, Organization grants you a non-exclusive, non-transferable, revocable, limited license to access and make personal use of the Site. The materials provided on or through the Site (including logos, text, graphics, photographs, video, and audio) remain the property of Organization and its licensors, protected by copyright, trademark, and other applicable laws.
Limitations on Use. You may not copy, reproduce, republish, upload, download, modify, frame, transmit, reverse engineer, or distribute any portion of the Site without the express written permission of Organization. You may not use data mining, robots, or similar data extraction tools on the Site, nor may you use the Site for any unlawful or unauthorized purpose.
4. SUBMISSIONS AND USER CONTENT
When registering for programs, making payments, or contacting us through the Site, you may submit or upload information ("Submissions"). You agree that all Submissions will be accurate and will not violate any law or the rights of any third party. You agree not to upload or transmit content that is libelous, obscene, harmful, invasive of privacy, or contains computer viruses or malware. Organization reserves the right (but not the obligation) to monitor, edit, or remove any Submissions, and to disclose Submissions as necessary to satisfy legal obligations or protect our rights.
5. THIRD-PARTY LINKS AND CONTENT
The Site may contain links to third-party websites, services, or resources (such as payment processors, scheduling platforms, or social media pages). Organization does not endorse and is not responsible or liable for any content, advertising, products, or services available from such third-party sites. Your interactions with third-party sites are solely between you and the respective third party.
6. INTELLECTUAL PROPERTY AND COPYRIGHT CLAIMS
If you believe in good faith that materials hosted on the Site infringe your copyright under the Digital Millennium Copyright Act (DMCA), you or your agent may send us a notice requesting that the material be removed or blocked. Notices should be submitted directly to Organization at lanakilainfo@gmail.com.
7. PRIVACY POLICY
All information provided by you or collected by us during your visits to the Site is governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Please review our Privacy Policy to understand our practices.
8. ELECTRONIC COMMUNICATIONS
By visiting the Site, submitting online forms, or sending emails to Organization, you consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
9. DISCLAIMERS
THE SITE AND ALL CONTENT, SERVICES, AND FEATURES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY ORGANIZATION ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, ORGANIZATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ORGANIZATION DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, LANAKILA VOLLEYBALL ACADEMY, ITS DIRECTORS, OFFICERS, EMPLOYEES, COACHES, VOLUNTEERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES OBTAINED THROUGH THE SITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Lanakila Volleyball Academy, its officers, directors, employees, coaches, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Site.
12. GOVERNING LAW AND JURISDICTION
These Terms of Use shall be governed by and construed in accordance with the laws of the State in which Lanakila Volleyball Academy primarily operates, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in that jurisdiction.
13. SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Terms of Use is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement between you and Organization regarding the subject matter herein.
